• Erika Jayne and Tom Girardi are being sued for fraud and embezzlement.
  • The lawsuit claims their divorce is a “sham” to “fraudulently protect Tom’s and Erika’s money.”

In news truly no one saw coming, Erika Jayne and her husband Tom Girardi are being sued for fraud and embezzlement?!?! According to The Chicago Sun-Times, Us Weekly, People, and USA Today, class action firm Edelson PC filed federal court documents on December 2 claiming Erika and Tom “are on the verge of financial collapse and locked in a downward spiral of mounting debts and dwindling funds.” Tom’s law firm, Girardi & Keese (GK), is also named in the suit.

Oh, and the suit claims that the couple’s divorce is a sham, alleging “While Erika publicly filed for divorce this month, on information and belief, that ‘divorce’ is simply a sham attempt to fraudulently protect Tom’s and Erika’s money from those that seek to collect on debts owed by Tom and his law firm GK.”

The lawsuit goes on to allege that Tom’s “need to fund outrageous lifestyles for himself and his soon-to-be ex-wife” is the reason Erika filed for divorce after 21 years of marriage. I’ll give you a moment to because the next piece of info is even more !!!!

Kay? Kay. The suit further alleges that Tom and Erika embezzled from settlement funds meant to help the families of people who died in a 2018 Lion Air Flight 610 plane crash, using money intended for Tom’s clients to “release personal guarantees, pay down loans, route the money to friends and family and satisfy other outstanding debts.” The complaint filed against them by Edelson PC in Illinois federal court is on behalf of families who lost loved ones in the crash.

This all sounds incredibly complicated and messy. Thus far, neither Tom nor Erika have commented on the claims publicly and Erika’s team hasn’t responded to Cosmo‘s request for comment, but Erika did post this, so!
